क्या प्राईवेट स्कूलों की लूट को सरकार का समर्थन हासिल है

शिमला/शैल। प्रदेश के प्राईवेट स्कूल बच्चों और अभिभावकों के उत्पीड़न का केन्द्र बनते जा रहे हैं यह कड़वा सच इन स्कूलों द्वारा बढ़ाई जा रही फीसों से सामने आ चुका है। फीसों के साथ ही स्कूल की वर्दी, जूते और किताबें आदि भी इन स्कूलों द्वारा चिन्हित दुकानों से ही लेना अनिवार्य कर दिया गया है। स्कूलों की इस मनमानी के खिलाफ कई बार अभिभावक रोष प्रकट कर चुके हैं। इन दिनों छात्र- अभिभावक मंच इस मुद्दे पर आन्दोलन पर उत्तर आया है। शिक्षा निदेशालय पर धरना प्रदर्शन हो चुका है। यह आन्दोलन जारी है और इसी आन्दोलन के प्रभाव स्वरूप शिक्षा निदेशालय ने 19 मार्च को एक कार्यालय निर्देश जारी किया है। इस निर्देश में कहा गया है कि प्रदेश में निजि शिक्षण संस्थान (विनियम) अधिनियम 1997 और शिक्षा का अधिकार अधिनियम 2009 लागू है। प्रत्येक स्कूल को इनकी अनुपालना सुनिश्चित करने के निर्देश दिये गये हैं। चार बिन्दुओं पर अनुपालना के निर्देश जारी हुए हैं।
यह निर्देश 18 मार्च को जारी किये गये हैं विनियमन अधिनियम 1997 में बन गया था लेकिन इस अधिनियम के तहत संचालन के नियम छः वर्ष बाद 2003 में बने। इन नियमों के तहत स्कूलों को निर्देश अब 2019 में जारी हो रहे हैं। इसी से सरकार की ईमानदारी और गंभीरता का पहला परिचय मिल जाता है। स्मरणीय है कि प्रदेश उच्च न्यायालय में 2014 में दो याचिकाएं दायर हुई थी इन पर 27 अप्रैल 2016 को फैसला आया है। इस फैसले में कहा गया है कि
a It is shocking that the private institutions have been raising their assets after illegally collecting funds like building fund, development fund, infrastructure fund etc. It is high time these practices are stopped forthwith and there is a crack down on all these institutions. Every education institution is accountable and no one, therefore, is above the law. It is not to suggest that the private education institutions are not entitled to their due share of autonomy as well as profit, but then it is out of this profit that the private education institutions, including schools are required to create their own assets and other infrastructure. They cannot under the garb of building fund etc. illegally generate funds for their “business expansion” and create “business empires”.
a That apart, it is the responsibility of the institution imparting education to set up proper infrastructure for the students and, therefore, the fee charged towards building fund is both unfair as well as unethical.
a In these given circumstances, the Chief Secretary to Government
of Himachal Pradesh is directed to constitute a committee which shall carry out inspection of all the private education institutions at all levels i.e. schools, colleges, coaching centres, extension centres, (called by whatever name), universities etc. throughout the State of Himachal Pradesh and submit report regarding compliance of the H.P. Private Educational Institutions (Regulation) Act, 1997 within three months. Special emphasis and care shall be taken to indicate in the report as to whether the private institutions have the requisite infrastructure, parents teacher associations, qualified staff, whether these institutions are maintaining the accounts in terms of Rule 6 and are regularly submitting all the information in the forms prescribed under the Rules and are further charging the ‘fee’ as approved by the Govt.
The Committee shall further report regarding violations being carried out by the educational institutions with respect to the guidelines issued by the UGC from time to time as have otherwise been taken note of in this judgment and shall be free to report violation of any Act, Rule, statutory provisions, guidelines etc., irrespective of the fact that the same have been issued by the Central or the State Governments.
a In the meanwhile, the respondent-State is directed to ensure that no private education institution is allowed to charge fee towards building fund, infrastructure fund, development fund etc.
a In addition to this, the Principal Secretary (Education) is directed to issue mandatory orders to all educational institutions, whether private or government owned, to display the following detailed information on the notice board which shall be placed at the entrance of the campus and on their websites:-
i) Faculty and staff alongwith their qualifications and job experience (profile).
ii) Details of Infrastructure.
iii) Affiliation alongwith certificate (s) of affiliation.
iv) Details of Internship andplacement.
v) Fees with complete breakup and details.
vi) Extra curricular activities with complete details.
vii) PTA-with address and telephone numbers of its members.
viii) Transport facilities with details.
ix) Age of the institute and its achievements (if any).
x) Availability of scholarships with complete details.
xi) List of alumni (s) alongwith complete addresses and telephone numbers.
The aforesaid information shall also be displayed on the website of all private educational institutions and in case any educational institution is currently not having its own website, the same shall be created within one month and immediately thereafter the aforesaid information would be displayed on the website.
इस फैसले के परिदृश्य में यह सवाल उठता है कि सरकार ने इस फैसले को गंभीरता से क्यों नहीं लिया? क्योंकि स्कूलों की यह लूट यथावत जारी है। प्राईमरी के बच्चों तक से छःछः हज़ार वसूले जा रहे हैं और इसमें सरकार के इन निर्देशों के बाद इन फीसों के जो हैड स्लिप में पहले दर्शाये जाते थे उन्हें हटा दिया गया है। सारा पैसा इकट्ठा बिना हैड दिखाये लिया जा रहा है। उच्च न्यायालय ने प्रदेश के मुख्यसचिव और शिक्षा सचिव को निर्देश दिये थे और रिपोर्ट मांगी थी जो आज तक नहीं बनी है। क्योंकि सरकार के अपने स्कूलों की स्थिति भी ठीक नहीं है। सरकार के दावे के मुताबिक प्रदेश 3391 स्कूलों में नर्सरी और केजी की कक्षायें शुरू कर दी गयी हैं और इनमें 23800 बच्चों ने दाखिला भी ले लिया है। विधानसभा में आये एक प्रश्न के उत्तर में सरकार ने माना है कि इन कक्षाओं के लिये अलग से अध्यापकों के कोई पद सृजित नहीं किये गये हैं। इस दौरान केवल 578 टीजीटी 123 भाषा अध्यापक, 79 कला अध्यापक, 234 शास्त्री नियुक्त किये गये हैं। इससे अन्दाजा लगाया जा सकता जा सकता है कि इन 3391 स्कूलों की स्थिति क्या होगी। इसी तरह योग शिक्षकों की स्थिति है। योग शिक्षा शुरू कर दी गयी है और अध्यापक हैं नही। जब सरकारी स्कूलों की स्थिति यह होगी तो विवश होकर लोगों को प्राईवेट स्कूलों का रूख करना पड़ेगा। इससे यह स्पष्ट हो जाता है कि इन स्कूलों की लूट को अपरोक्ष में सरकार का समर्थन भी हासिल है।
