फर्जी डिग्री मामले में अगस्त 2017 की शिकायत पर फरवरी 2020 में एफआईआर दर्ज
मामला दर्ज करनें में इतनी देरी क्यों
प्रदेश उच्च न्यायालय के तीन न्यायधीशों ने जांच की धीमी गति पर उठाये हैं सवाल
शिमला/शैल। पूर्व मुख्यमन्त्री शान्ता कुमार ने प्रदेश में घटे फर्जी डिग्री प्रकरण को हिमाचल के माथे पर कलंक करार देते हुए इसकी निष्पक्ष और शीघ्र जांच की मांग की है। शान्ता कुमार ने आरोप लगाया है कि वर्षों से फर्जी डिग्रीयां बिकती रही और प्रदेश की सीआईडी को पता ही नहीं चला यह कैसे संभव हो सकता है। उन्होंने इसकी जांच तेज करने के लिये मुख्यमन्त्री जयराम ठाकुर और डीजीपी संजय कुण्डु से भी आग्रह किया है। प्रदेश में फर्जी डिग्रीयां बेचने के आरोप मानव भारती विश्वविद्यालय पर लगे हैं। शान्ता कुमार द्वारा यह विषय उठाने से पहले कांग्रेस विधायक राजेन्द्र राणा ने भी यह विषय उठाया है। राणा ने इस सबंध में विधानसभा में भी एक सवाल उठाने का दावा किया है। यह सवाल सदन में चर्चा के लिये नहीं आ पाया है। राणा के मुताबिक मानव भारती विश्व विद्यालय की स्थापना में ही घोटाला होना शुरू हो गया था। प्राईवेट सैक्टर में विश्व विद्यालय खोलने के लिये पचास बीघे जमीन चाहिये। राणा के मुताबिक मानव भारती विश्व विद्यालय के पास वांच्छित भूमि नहीं थी और इसलिये दो बार उनका आवेदन रद्द हुआ है। उसके बाद तीसरी बार उनको यह स्वीकृति मिल गयी। राणा के मुताबिक यह स्वीकृति मिलने में बड़े स्तर पर बड़ा लेनदेन हुआ है। इसी लेनदेन के आधार पर आगे चल कर इस विश्व विद्यालय की डिग्रीयां बिकना शुरू हुई जिस पर सरकार द्वारा यह कारवाई नहीं की गयी। राजेन्द्र राणा और फिर शान्ता कुमार द्वारा यह विषय उठाने के बाद प्रदेश के राजनीतिक और प्रशासनिक हल्कों में भूचाल आ गया है। क्योंकि शान्ता कुमार ने उनकी अभी छपी जीवनी में केन्द्र की वाजपेयी और मोदी सरकारों पर भ्रष्टाचार को संरक्षण देने के आरोप जिस तर्ज पर लगाये हैं उससे उनके ब्यान को बहुत ही गंभीरता से लिया जा रहा है। क्योंकि उनका आरोप है कि जिन लोगों को जेलों में होना चाहिये वह आज खुले में घूम रहें है। शान्ता कुमार ने अपनी आत्मकथा में जिस तरह के आरोप भाजपा सरकारों के खिलाफ लगाये हैं यदि कल उन्हें विपक्ष मुद्दा बनाकर सरकार से सवाल पूछना शुरू कर देता है तो सरकार के लिये एक बड़ी परेशानी खड़ी हो जायेगी यह तय है। इस परिदृश्य में फर्जी डिग्री प्रकरण की पड़ताल करके सारे तथ्य आम आदमी के सामने लाना आवश्यक हो जाता है क्योंकि इस मामले में प्रशासनिक स्तर पर बहुत ढील रही है यह सही है।
स्मरणीय है कि हिमाचल प्रदेश को शैक्षणिक हब बनाने के लिये वर्ष 2009-10 में प्राईवेट सैक्टर में बहुत सारे विश्व विद्यालय खोलने की अनुमतियां दी गयी थी। इसी में मानव भारती विश्व विद्यालय ने भी ऐसी अनुमति के लिये आवेदन किया था। इस आवदेन को पहली बार अस्वीकृत कर दिया गया क्योंकि उनके पास वांच्छित पचास बीघे ज़मीन नहीं थी। बाद में और बीस बीघे ज़मीन दूसरे स्थान पर खरीदकर यह आवदेन किया कि वह यह परिसर दो स्थानों पर खोलना चाहते हैं इस आग्रह के साथ जब यह मामला मन्त्रीमण्डल की बैठक में आया तब इन्हें अनुमति प्रदान कर दी गयी। यह अनुमति मिलने के बाद विश्व विद्यालय ने वर्ष 2009-10 से शैक्षणिक सत्र शुरू कर दिया। 2009 से 2013 तक के सत्रों में 45 कोर्सो में अध्यापन शुरू हो गया। लेकिन इसी दौरान यह शिकायतें आना शुरू हो गयीं कि बहुत सारे कोर्स शुरू करवा दिये गये हैं जिनके लिये सक्ष्य अथॉरिटी से स्वीकृति ही नहीं है। इन शिकायतों पर सरकार ने 17-2-2012 को पत्र संख्या EDN-A-Ka(5)&1@2011 के तहत जांच के आदेश कर दिये। इन आदेशों पर पीएचडी कोर्स को बन्द कर दिया। यही नहीं जिन 45 कोर्सो में अध्ययन शुरू किया गया था उनमें से 31 को बन्द करवा दिया गया था। इन अनियमितताओं के लिये इन्हें एक करोड़ रूपये का जुमार्ना भी लगाया गया था।
प्राईवेट सैक्टर में खुले इन विश्वविद्यालयों पर जब सवाल उठने शुरू हुए थे तब सरकार ने इनके लिये एक नियामक आयोग का गठन भी कर दिया था जिसकी अध्यक्ष सरोजनी ठाकुर वरिष्ठतम आई एएस अधिकारी को लगाया गया। इस आयोग के पास जब मानव भारती विश्व विद्यालय को लेकर शिकायत आई तब इसकी जांच के लिये 20-8-2014 को सेवा निवृत आईएएस अधिकारी सीआरवी ललित की अध्यक्षता मे एक तीन सदस्यों की कमेटी गठित कर दी। इस कमेटी की रिपोर्ट पर 1-4-2016 को नियामक आयोग का फैसला आया है। इस फैसले में यह सामने आया है कि इस विश्व विद्यालय ने दिसम्बर 2012 तक कोई कन्वोकेशन ही आयेजित नहीं की है और न ही कोई डिग्रीयां बांटी गयी है। इसकी पहली कन्वोकेशन दिसम्बर 2013 में वीरभद्र शासन के दौरान हुई और अभी डिग्रीयां बांटी गयी। इसलिये फर्जी डिग्रीयां होने और बांटने का विषय ही 2013 से व्यवहारिक रूप से शुरू होता है। इसके बाद ही नियामक आयोग और शिक्षा विभाग पर आयोग की सचिव एकता काप्टा 16-8-2017 को डीजीपी को शिकायत भेजकर इस प्रकरण में मामला दर्ज करने का आग्रह करती है और मामला दर्ज हो जाता है। 16-8-2017 को आयोग की शिकायत पर फरवरी और मार्च 2020 मे एफआईआर दर्ज होते हैं और गिरफ्तारीयां शुरू होती हैं। 2017 की शिकायत पर 2018-2019 में एफआईआर क्यों दर्ज नहीं होते हैं इसका कोई खुलासा सामने नहीं आया है। इस मामले में पहली गिरफ्तारी इण्डस विश्वविद्यालय के लेख राज की होती है जिसे 13-2-2020 को प्रदेश उच्च न्यायालय की न्यायमूर्ति विवेक ठाकुर की पीठ से ज़मानत मिल जाती है। इसके बाद इसी मामले में गिरफ्तार प्रमोद कुमार को 5-6-2020 को न्यायमूर्ति चन्द्र भूषण बारोवालिया की पीठ से ज़मानत मिल जाती है। फिर 18-11-2020 को राज कुमार राणा को न्यायमूर्ति अनुप चिटकारा की पीठ से ज़मानत मिल जाती है और 31-5-2021 को अजय कुमार को इसी पीठ से ज़मानत मिल जाती है। ज़मानत के यह मामले तीन अलग-अलग ज़जों के पास आते हैं और सभी ने पुलिस की जांच पर अप्रसन्नता व्यक्त की है। नियामक आयोग से लेकर उच्च न्यायालय तक यह कहीं नहीं आया है कि 2012 तक आयी शिकायतों पर कारवाई करने में कोई ढील बरती गयी है। न ही यह सामने आया है कि 2012 तक ही फर्जी डिग्रीयां बिकनी शुरू हो गयी थीं। ऐसे में यह सवाल बड़ा हो गया है कि जब नियामक आयोग ने अगस्त 2017 में ही डीजीपी को शिकायत भेज दी थी तो उस पर एफआईआर दर्ज करने में करीब अढ़ाई वर्ष की देरी क्यों की गयी?
नियामक आयोग का 01-04-2016 का फैसला
In the light of above, the MBU is ordered:
(i) To ensure that they maintain counterfoils of receipt books for all transactions for years after students have passed out and that accounts should be maintained digitally and such records should be
preserved in perpetuity.
(ii) To seal the old degrees and abandon using the series and get new degrees printed with proper multiple secrecy features which it issues seriatim. This will preclude any danger of repetition of complaints which have been received regarding MBU.
(iii) The MBU was ordered to upload information pertaining to the degrees that it has actually awarded on its website and also the details of the passed out candidates. After several hearings the MBU has now made a public disclosure through its website of list of the details of (1) degrees awarded till date and (2) details of passed out candidates from the University. This can be accessed by anybody from their website. The MBU needs to keep updating this as a continuous process as and when degrees are awarded or students passed out but have not been awarded degrees.
The public notice referred in para-V has effectively clarified that all degrees apart from those on the website are fake and have not been issued by the University.
VII. In view of the compliance reported by MBU as indicated in para-V and findings rendered in para-VI of the Order, the controversy involved has been set at rest. In the interest of transparency of award of degrees and to obviate possible malpractices, all the Private Universities in the State are ordered to make public disclosure on their respective websites regarding course wise degrees awarded till date and list out candidates who have passed out but award of degrees is awaited.
Copy of the order be supplied to the MBU.
Operative part of para-VII of the order, so far as applicable to all
the State Private Universities be communicated to all separately.
Copy of the order is not required to be supplied to complainant(s)
in view of the public notice issued by MBU.
Copy of the orders be supplied to the Director Higher Education Himachal Pradesh (through whom reference of UGC regarding complaint of Dr. J.C. Bhatia has been received) with reference to his letter dated 7.8.2014.

नियामक आयोग का अगस्त 2017 का डीजीपी को शिकायत पत्र
FACTS
(a) The gist of the First Information Report and the investigation is that way back on Aug 16, 2017, the Secretary of Himachal Pradesh Private Education Institutions Regulatory Commission sent a complaint addressed to the Director General of Police, Himachal Pradesh, Shimla-2, which is reproduced as under:

Subject: Issue regarding 103 Degrees/Diplomas issued by Manav Bharti University, Laddo, Sultanpur, Distt.Solan (HP) which were found to be fake on verification.
Sir,
I am directed to submit that this Commission has been formed with an objective providing a regulatory mechanism in the State and for working as an interface between the State Government and Central Regulatory Bodies for ensuring appropriate standards of admission, teaching examination, research and protection of interest of students in the Private Educational institutions and for matters connected therewith or incidental thereto. This Commission received a request from the Directorate of Higher Education on 06.01.2017 for verification of 103 degrees diplomas issued by the Manav Bharti University in various disciplines (Copy along with the list of candidates and their particulars as Annexure-I is enclosed for kind perusal). The matter for verification of degrees/diplomas was taken up with the Registrar, Manav Bharti University, Solan vide this office letter No. HPPERC 28 MBU-Vol- III/2016-3813 dated 03.03.2017 (copy enclosed). But the
University in its response dated 10.03.2017 denied having issued any documents with respect to these 103 degrees/diplomas (copy enclosed as Annexure-II). Your kind attention is drawn to the fact that from the bare p1erusal of the degrees/diplomas enclosed it is evident that the same have been issued by Manav Bharti University, Solan.
However, from the refusal of issuance of these documents by the University it has questioned the sanctity of these degrees/diplomas. Therefore, there is sufficient incriminating material which shows that the degrees/diplomas in question are not genuine. Hence, a high-level investigation is required to be done as it is a serious issue. You are therefore requested to look into the matter and direct a high-ranking officer of your department to investigate the matter in order to reveal the truth behind the issue and thereafter taken action in accordance with law. This Commission will extend all kinds of possible assistance to the investigating officer in the matter.
