वोट की राजनीति भारी पड़ सकती है एन जी टी के फैसले पर
शिमला/शैल। नेशनल ग्रीन ट्रिब्यूनल ने 16-11-2017 को दिये अपने फैसले में शिमला के कोर एरिया में नये निर्माणों पर प्रतिबन्ध लगा रखा है। नॉन कोर ऐरिया में भी अढ़ाई मंजिल से अधिक के निर्माण पर प्रतिबन्ध है। यहां पर निर्माण की संस्तुति के लिये कुछ कमेटियां भी गठित की है। एन जी टी का फैसला आने के बाद पुरे प्रदेश में हड़कंप मच गया था। क्योंकि फैसले में सरकार को प्लानिंग पॉलिसी बनाने के भी निर्देश दिये गये थे। पूरा प्रदेश भूकम्प जोन में आता है। एन जी टी ने योगेन्द्र मोहन सेन की याचिका पर फैसला देते हुए स्पष्ट कहा है कि फैसला देने से पहले कैग की रिपोर्ट पर चिन्तन मनन किया गया है। कैग ने स्पष्ट कहा है कि there was no proper regulation of constructions in hill areas of Himachal Pradesh resulting in earthquakes and other calamities. कैग के अतिरिक्त आपदा प्रबन्धन अधिनियम 2005 के प्रावधानों पर भी विचार किया गया है। इसी के साथ एन जी टी ने इस संद्धर्भ में गठित विशेषज्ञ कमेटियों की रिपोर्टों पर भी विचार किया है। 24-05-2017 को आयी विशेषज्ञ कमेटी की रिपोर्ट का फैसले में उल्लेख भी है। Recommendations on Disaster Risk Management From a Disaster Risk Management perspective, Shimla has far exceeded its carrying capacity, Uncontrolled and unsafe construction over decades has created and extremely vulnerable built environment in Shimla. A major earth Quake will lead to unprecedented loss of lives, cripple the administration and disrupt all sectors of the economy particularly the tourism sector. Any further increase in the density of the built environment will exponentially increase the risk of the damages and losses from disasters. In fact, there is a need to reduce the density of Shimla by taking some bold steps including some conservative surgery of the current built environment by removing or retrofitting some of the most vulnerable buildings.
The committee presents its recommendation in three categories:
Stop the creation of new vulnerabilities and risks;
Reduce existing vulnerabilities and risks; and
Increase local emergency response capacity for a major Earthquake.
लेकिन वोट की राजनीति से ग्रसित सरकार ने एन जी टी के फैसले की अनुपालना करने की बजाये इसे सर्वोच्च न्यायालय में चुनौति दे दी जहां पर यह मामला अभी तक लंबित है। सुप्रीम कोर्ट ने एन जी टी के फैसले को स्टे तक नही किया है। इसका अर्थ है कि एन जी टी का फैसला आज भी पूरी तरह लागू है। इसी बीच सरकार ने कई और याचिकाएं एन जी टी में दायर की जिन्हे अस्वीकार कर दिया गया। बल्कि एक प्रदेश उच्च न्यायालय ने भी अपने पुराने भवन को गिरा कर नया भवन बनाने की अनुमति दिये जाने के लिये दायर की थी और एन जी टी ने इसे अस्वीकार कर दिया है। सर्वोच्च न्यायालय में 16-11-2017 के फैसले के खिलाफ दायर हुई याचिका अब तक विचाराधीन है। लेकिन इसी बीच प्रदेश उच्च न्यायालय में एन जी टी के कुछ फैसलों का चुनौति दे दी गयी। उच्च न्यायालय ने सरकार की सारी याचिकाएं यह कह कर खारिज़ कर दी है कि जब मुख्य फैसले को सुप्रीम कोर्ट में चुनौति दी जा चुकी है तब इन याचिकाओं को भी वहीं उठाया जाये। प्रदेश उच्च न्यायालय के समक्ष यह मामले उठाये गये थे। So far as CWP No. 7105 of 2021 is concerned, the challenge has been made to the order dated 13.9.2021 (Annexure P-8), whereby the applications bearing MA No. 59 of 2021 and MA No. 60 of 2021 were dismissed. So far as MA No. 59 of 2021 is concerned, the construction alleged to be involved was with regard to installation of lift in existing structure of the building along with remodeling of roof and so far as MA No. 60 of 2021 is concerned, it involves construction with regard to lift and ramp for physically challenged persons in Ellerslie Main Building at H.P. Secretariat, Shimla-2; visitors’ waiting hall for Chief Minister Office; extension of car parking at Armsdale Building at H.P. Secretariat, Shimla and multi-storey parking and office accommodation at Armsdale Phase-III, H.P. Secretariat Shimla-2.
So far as CWP No. 295 of 2022 is concerned, the petitioner -State has challenged the order dated 31.8.2021, passed in MA Nos. 56, 57 and 58 of 2021, whereby the applications filed by the State for a direction to permit the project of multi-level parking and other commercial activities, including hotel on the railway land (Railway Godown below Winter Field) at Shimla and for permission to file additional documents, were dismissed.
इस पर उच्च न्यायालय ने साफ कहा है
Respondent No.1 Yogendra Mohan Sengupta had approached the Tribunal by filing Original Application No. 121 of 2014. The said application was disposed of by the Tribunal vide order dated 16.9.2017 (Annexure P-1). Admittedly, aggrieved against the said order, petitioner-State has filed an appeal before the Hon’ble Supreme Court under Section 22 of the National Green Tribunal Act, 2010.
Thereafter, the petitioner-State moved some miscellaneous applications, seeking permission to raise constructions or other commercial activities. The said applications have been rejected by the Tribunal vide impugned orders dated 13.8.2021 and 13.9.2021. The orders under challenge in the present petitions have arisen out of miscellaneous applications filed in O.A. No. 121 of 2014. Since the appeal against order dated 16.11.2017, passed by the Tribunal in O.A. No. 121 of 2014 is pending consideration before the Hon’ble Supreme Court, we are of the considered opinion that the orders passed by the Tribunal, arising out of miscellaneous applications filed in O.A. No. 121 of 2014 are liable to be challenged before the Hon’ble Supreme Court, so that they can be considered and decided alongwith the appeal, pending before the Hon’ble Supreme Court. It is not understandable as to why these petitions have been filed before this Court, when the matter is already sub-judice before the Hon’ble Supreme Court vis-à-vis order dated 16.11.2017, passed in the Original Application. The miscellaneous applications can be said to be an off-shoot of the main case. लेकिन इस वस्तुस्थिति के बाद भी यह निर्माण सचिवालय में चलते रहे हैं। इसमें सबसे रोचक तथ्य तो यह है कि सरकारी निर्माणों पर टी सी पी अधिनियम की धारा 38 लागू होती है। धर्मशाला के मकलोड़गंज प्रकरण में सुप्रीम कोर्ट में यह एक बड़ा आधार रहा है। परन्तु यहां पर किसी भी सरकारी निर्माण में इसकी अनुपालना नही हुई है। स्मार्ट सिटी के नाम पर हो रहे निर्माणों में भी इसकी अवहेलना हुई है। बल्कि यह कहना ज्यादा सही होगा कि वोट की राजनीति के चलते पहाड़ को मैदान बनाने के जो प्रयास हो रहे हैं उनके परिणाम कालान्तर में घातक होंगे।
