क्या अपरोक्ष में प्राईवेट स्कूलों के लिये वातावरण बनाया जा रहा है

शिमला/शैल। प्रदेश के कई स्कूलों में अध्यापकों और आधारभूत ढांचों की कमी है तो कई स्कूलों में छात्रों की इतनी कमी हो गयी है कि वहां पर सरकार अध्यापकों की नियुक्ति कर पाने में असमर्थता महसूस कर रही है। मण्डी के डोघरी में स्थित स्कूल में अध्यापकों की कमी को लेकर यहां के छात्रों को एक जनहित याचिका के माध्यम से यह स्थिति प्रदेश उच्च न्यायालय के सामने रखनी पड़ी है।  उच्च न्यायालय ने इसका कड़ा संज्ञान लेते हुए इन रिक्त पदों को भरने और 1-1-2020 को सभी विषयों मे होने वाले रिक्त स्थानों उनको भरने की प्रक्रिया में शुरू किये गये कदमों की जानकारी अदालत के सामने रखने के निर्देश दिये। इसी के साथ शारीरिक शिक्षा के अध्यापकों और स्कूलों के युक्तिकरण पर भी जानकारी मांगी। प्रधान सचिव शिक्षा ने इस संबंध में उच्च न्यायालय में यह जानकारी रखते हुए अपने शपथपत्र में कहा है कि विभाग के पास विभिन्न विषयों के अध्यापकों के 3636 पद रिक्त होंगे। इन पदों को भरने के लिये वित्त विभाग से आवश्यक स्वीकृति लेकर अगली प्रक्रिया शुरू कर दी है। मन्त्रीमण्डल ने भी इन पदों को भरने की स्वीकृति दे दी है।
 लेकिन इस पर जब उच्च न्यायालय ने युक्तिकरण को लेकर पूछा तो महाधिवक्ता ने बताया कि कई स्कूलों में छात्रों की संख्या इतनी कम है कि वहां सरकार के लिये अध्यापकों की नियुक्ति कर पाना संभव नही है। इसका कड़ा संज्ञान लेते हुए अदालत ने कहा कि तब तो अनचाहे ही कई स्कूल अपने आप ही बन्द हो जायेंगे। क्योंकि जब स्कूलों में अध्यापक और आधारभूत ढांचा ही उपलब्ध नही होगा तो बच्चे कहां से और क्यों आयेंगे। अदालत ने कहा है कि During the course of hearing, the Principal Secretary(Education) to the Government of H.P. filed an affidavit stating that steps have been taken for finalization of R&P Rules of Lecturer(School New) and DPE and necessary steps to fill up the vacant posts of these categories will be initiated immediately. He also stated that as on 31.12.2019, 693 posts of JBT, 590 posts of Language Teacher, 1049 posts of Shastri, 684 of TGT(Arts), 359 posts of TGT(Non-medical) and 261 posts of TGT(Medical) are lying vacant, for which the concurrence of Finance Department has been obtained and the approval of Cabinet is required, after which steps for selection shall be taken immediately.
During the course of hearing, Advocate General pointed out that in some of the Government schools, the attendance of the students is very thin and it is not suitable for the Government to appoint teachers/lecturers or to run such Government Schools.
The Court showed its displeasure over the slow selection process of teachers by the Department of Education and submissions of Advocate General that some of the Government schools are at the verge of closure due to thin attendance of the students.
The Court observed that until and unless the Government creates and runs the schools in good atmosphere and provide adequate infrastructure for the students to attend schools, it cannot be expected that students will get admitted to the Government Schools. The Court further observed that the slowness on the part of the Government results in gradual migration of the students to private schools and if this continues for long, time would come that the Government though unintentionally would close down the Government schools, which will become an alarming situation. The Court also observed that the poorer section and agricultural laborers cannot be expected to send their children to private schools due to huge incurring of expenditure and it shall be the duty of the Government to provide education to this lower strata of society. The Court said that though Artilce 21-A of the Constitution provides free and compulsory education to all children in the age group of six to fourteen, but the same seems to be defeated. महाधिवक्ता के तर्क से यह सवाल खड़ा हो जाता है कि जब यह स्कूल खोले गये थे तब क्या इनमें आवश्यक पदों के सृजन के लिये वित्त विभाग से स्वीकृति नही ली गयी थी? क्योंकि वित्त विभाग की पूर्व स्वीकृति के बिना कोई भी संस्थान नहीं खोला जाता है। जब उस समय सरकार के पास वित्तिय संसाधन उपलब्ध थे तो आज वह साधन कहां चले गये? क्या आज शिक्षा सरकार की प्राथमिकता नही रह गयी है? क्या सरकार अपरोक्ष में प्राईवेट स्कूलों के लिये वातावरण तैयार कर रही है।
